What is the OCP?

What does the term OCP mean? It is a type of insurance, which is subject to the carrier performing paid transportation of goods. Most often, the insurance contract is concluded with an insurance company for a year - it is worth noting that the Polish law does not impose an obligation to sign such an agreement. Using the OCP is voluntary and allows transfer of financial responsibility for the cargo to the insurer. Depending on the content of the contract, it can protect against various unexpected events on the road and during the execution of the order - some of them are not the carrier's fault. Carrier with OCP insurance is also a greater certainty that the customer seeking compensation for the poor performance of transport services will receive money faster. Financial compensation should be paid to the client's account no later than 30 calendar days. This is a kind of protective umbrella, which is often used especially by large carriers on the domestic and international market. Therefore, it is always worth buying it for the needs of your company.
 

OCP policy - what benefits does it bring?
OCP policy - what are the benefits? It is very useful insurance that provides a financial cushion for improperly and unperformed transport services in domestic and international transport. Depending on the type of contract, these can be:
 

  • theft,
  • damage,
  • cargo destruction,
  • delays in goods,
  • gross negligence in carrying out the order,
  • delivery of cargo to an unauthorized person,
  • Liability for errors of subcontractors,
  • intentional causing of failure to execute an order.

 

This is an illustrative list - implementation of the sub-items depends on the insurance company. Each of them specifies the scope of their services, as well as the amount of money involved in their realization. In this case, it is worth betting on a higher priced package or checking the offer of the competition.

Third-Party Liability policy - does it remove all liability from employees? Most insurance packages financially protect companies from damage or destruction of customer cargo. However, everything is subject to the requirements of the insurance company and failure to meet them may result in non-payment of compensation. In extreme cases and in the case of insurance fraud, it may even result in legal liability. Third-party liability insurance does not exempt drivers, forwarders, and other employees from the diligent performance of their duties. This may be included in the subsection of the contract for the payment of compensation for an intentional act - however, this can be found in more expensive packages and offers only to some companies.

 

OCP insurance - how are the costs distributed?

How much does OCP insurance cost on the Polish market? This issue is again dependent on the insurer with whom we sign an agreement. Each of them differently calculates insurance premiums and discounts, and may also interpret subpoints of the contract differently. Most premiums are usually calculated on the basis of the company's turnover, the sum assured, the type of goods transported, and several other factors. Sometimes special discounts may be added for the carrier's diligent work and accident-free operation. It is worth remembering that the insurance sum should cover the full value of goods in one transport or the sum included in the consignment note. Nothing stands in the way of negotiating the final value of the policy.

 

Are there goods which are not covered by the OCP in transport? In theory, everything can be insured, but this often means giving up discounts or even a significant surcharge on the policy. The list of higher risk goods includes:
 

  • medicines,
  • money,
  • documents,
  • works of art,
  • live animals,
  • electronics,
  • alcohol,
  • tobacco.

 

Some of these goods belong to the high-risk group, which is referred to as ADR goods. A special agreement allows them to be transported only under certain conditions and by following the necessary procedures. This type of cargo is not favored by insurers, who may request not only a higher surcharge but also may refer to the provisions in the contract and withdraw from insuring them under the signed OCP policy. Therefore, before taking on their transportation, it is worthwhile to review the provisions of the insurance contract in advance. 

 

OCP transport - what types of insurance are there?

OCP insurance - what types of policies can be purchased? Currently, on the Polish market, there are two types. These are:

  • OCP insurance international,
  • domestic OCP insurance.

Why is there such a clear division between domestic and international policies? This is due to significant legal differences between the countries of the European Union and the rest of the world, as well as the provisions of the International Convention on Third Party Liability. Local legal regulations often use different legal interpretations and the very construction of provisions. Therefore, for the international transport markets, a separate OCP policy was created, which takes into account all these conditions. OCP as a contract is the subject of carrier liability. Insurance companies prefer to create separate single quotes instead of complex packages that are difficult to adapt to the requirements of other freight markets.
